Il volume indaga l'opus magnum di Elio Marciano, i libri institutionum, e ne predispone una palingenesi che tiene conto, oltre che degli elementi contenutistici dei singoli passi, anche dei paragrafi delle Istituzioni di Giustiniano riconducibili a quelle di Marciano, e di un frammento papiraceo recentemente attribuito all'opera del giurista. Prendendo le mosse dalle scarse informazioni sulla carriera (il giurista fu attivo in età severiana), viene prospettata l'ipotesi che Marciano non sia stato soltanto un giurista accademico', ma possa aver svolto la professione forense o qualche ruolo nell'amministrazione della giustizia, pur senza mai giungere a incarichi pubblici degni di particolare rilievo. L'analisi dei testi sembra far risaltare una notevole dipendenza da Papiniano, del quale il nostro potrebbe essere stato discepolo. Dalle tematiche affrontate, dalle categorie concettuali e da alcune soluzioni proposte, si comprende come Marciano fu, alla stregua dei principali giuristi severiani, tra gli artefici del cosiddetto giusnaturalismo romano.

The volume investigates the opus magnum of Aelius Marcianus, the Libri Institutionum, and prepares a palingenesis of it that takes into account not only the content elements of the individual passages, but also the paragraphs of Justinian's Institutions that can be traced back to those of Marcianus, and a papyrus fragment recently attributed to the work of the jurist. Starting from the scarce information on his career (the jurist was active during the Severian period), the hypothesis that Marciano was not only an academic'jurist, but could have played the legal profession or some role in the administration of justice, without ever reaching public offices worthy of particular importance. The analysis of the texts seems to highlight a considerable dependence on Papinianus, of whom ours may have been a disciple. From the themes dealt with, from the conceptual categories and from some proposed solutions, one can understand how Marcianus was, like the main Severian jurists, among the creators of the so-called Roman natural law.
